Section 10.13.2

REGULATIONS:

1. Compliance With Building Code; Permanent Foundation: All manufactured housing built after June 16, 1976, shall meet current building code requirements and placed with a permanent foundation, even if the home is a rental unit.
2. Skirting: Skirting shall consist of masonry, concrete or stucco. Minimum width of skirting will be six inches (6"). This requirement will be for all manufactured housing not required to be in a manufactured housing park.
3. Utilities: No manufactured housing shall have utilities turned on until all ordinances have been complied with and all inspections have been approved by the building inspector.
4. Tax Clearances Prior To Building Permit: A building permit will not be issued until a tax clearance is received from the appropriate county assessor's office.
5. Business License Required For Parks: Business licenses will be required on an annual basis (fiscal year) for all manufactured housing parks.
6. Nonconforming Manufactured Homes: If a manufactured home that does not meet the requirements of this section and title 9, chapter 4 of this code is removed from a lot within the city, the owner shall have one year (365 days) to replace the unit. If the unit is not replaced within one year, then all requirements of this section and title 9, chapter 4 of this code shall be met, unless otherwise provided in this subsection. If a manufactured home that was placed on a lot within the city before July 13, 1999, and was considered a nonconforming manufactured home after the enactment of title 9, chapter 4 of this code was removed from the lot within the city and not replaced within one year, the lot owner may petition the city to allow a special exception nonconforming manufactured home to be placed on the lot where the previous nonconforming manufactured home had been located. A permit may be granted to allow a special exception nonconforming manufactured home upon the following conditions:
1. The special exception nonconforming manufactured home may only remain on a lot within the city as long as the permit holder is still in compliance. These permits will be reviewed by the council every three (3) years.
2. The manufactured home can only be placed on existing manufactured home pads. And the special exception nonconforming manufactured home must comply with all other provisions of sections 9-4-9, 9-4-11, 9-4-12, and 9-4-14 of this code and this chapter. (Ord. 12-3, 9-25-2012)
