In subdivisions of less than five (5) lots, land may be sold by metes and bounds without the necessity of recording a final plat, if the following conditions are met:
1. A preliminary subdivision plat shall have been first approved by the planning commission, and where any guarantee of public facility improvements is involved, by the city council.
2. The subdivision is not transversed by the mapped lines of a proposed street, as shown on any official map of the city or proposed street or street to be widened as shown on the master street plan and does not require the dedication of any land for street or other public purposes.
3. Each lot in the subdivision meets the public street frontage, width and area requirements of the zoning ordinance, or has been granted a variance from such requirements by the board of adjustment.
4. All preliminary plat requirements have been complied with regarding the preliminary plat approved by the planning commission.
5. All provisions of the subdivision improvements of these regulations have been complied with.
6. The water supply and sewerage disposal systems have been approved by the city engineer.
7. The storm drainage and irrigation water systems, if available, have been approved by the city engineer. (Ord. 86-3, 3-11-1986)
