1. Prohibited Activities: Except as authorized by title 58, chapter 37 of the Utah code, as amended, it is unlawful for any person to knowingly and intentionally: 1) produce, manufacture, dispense and 2) possess with intent to produce, manufacture, or dispense or 3) distribute, or agree, consent, offer, or arrange to distribute or 4) possess with the intent to distribute 5) possess or use synthetic cannabinoids, more specifically identified as follows:

1.
1-Pentyl-3-(1-naphthoyl)indole

Some trade or other names: JWH-018;

2.
1-Butyl-3-(1-naphthoyl)indole

Some trade or other names: JWH-073;

3.
N-benzylpiperazine

Some trade or other names: BZP;

4.
1-(3-[trifluoromethylphenyl]) piperazine

Some trade or other names: TFMPP; or

5.
Any structurally similar analogs of the substances listed above.

2. Penalty: A violation of this section is a class B misdemeanor and each such violation shall be subject to a term of imprisonment not to exceed six (6) months and a fine not to exceed one thousand dollars ($1,000.00) and/or both.
3. Subsequent State Action: Except as otherwise provided in this chapter, should the Utah state legislature adopt a statute enacting criminal penalties for prohibitions set forth in this section, then upon the effective date of such state statute, this section shall no longer be deemed effective. Any violations of this section prior to a state statute becoming effective may be prosecuted.
4. Chemicals Confiscated And Destroyed: If any of the aforementioned intoxicating chemical compounds are found in the possession of any person, they may be confiscated and destroyed by law enforcement officials. (Ord. 10-3, 9-28-2010)
